Breaking is tenancy contract is a formal way of ending a tenancy agreement by the tenant. This can happen by sending a formal letter to the owner of the house. Tenancy agreement can be broken either by operation of the law or by declaration of the surrender.

Sample breaking a tenancy contract:

Date of Contract: November 15th, 2011.

This breaking a tenancy contract is between the house owner, Mr Ron Dickinson and the tenant, Mr Jack. The owner has the following property in his name:

123 Park Avenue, Apt 45, Edison, NJ 08817

The two parties entered into a tenancy contract on the 01 Jan 2006 and the tenant has since been residing in this above mentioned property.

Since the tenancy agreement is being broken with mutual consent of both the parties, the owner has the right of possession of the aforementioned property under the Housing Act, 1988.

Facilities to be surrendered by the tenant:

The tenant of the house should surrender the following:

  • The house being occupied
  • Furniture
  • Phone
  • Car parking space

Following mentioned are the covenants and conditions for both the parties:

Break Clause:

  • As per the agreement between the owner and the tenant, the tenant should vacate the house on or before Dec 01, 2011.
  • The owner will pay back the deposits paid by the tenant at the start of the tenancy contract.
  • The owner can deduct reasonable charges for breakage or damage to the owner’s property.
  • The tenant should clear all the due payments to the owner before vacating the house.
