A breach of tenancy contract is initiated when a tenant leaves the house without notice to the owner or owner violates the terms mentioned in the tenancy agreement. The following is one such breach of tenancy contract.

Sample Breach of Tenancy Contract:

Date of Contract: November 15th, 2011.

This breach of a tenancy contract is between the house owner, Mr Ron Dickinson and the tenant, Mr Jack. The owner has the following property in his name:

123 Park Avenue, Apt 45, Edison, NJ 08817

The two parties entered into a tenancy contract on the 01 Jan 2006 and the tenant has since been residing in this above mentioned property.

The tenant has moved out of the rented property without notice to the owner and hence the owner has decided to end the tenancy contract due to breach.

Following mentioned are the covenants and conditions for both the parties:

Break Clause:

  • As per the agreement between the owner and the tenant, the tenant should have formally ended the tenancy contract and breach of this rule would now necessitate litigation initiated by the owner.
  • The owner can claim charges for breakage or damage to the owner’s property by the tenant in the court of law.
  • The tenant should have cleared all the due payments to the owner before vacating the house. But since this has not happened, the tenant has the right to get punished under the Housing Law, 1988.

The decree given by the law would be binding on both the parties.
